These Terms of Service ("Terms") govern access to and use of the website, services, and related materials provided by Fairway Ops LLC, a Nevada limited liability company ("Fairway Ops", "we," "us," or "our"). By accessing or using the website or services, you agree to these Terms.

1. Services

Fairway Ops provides AI front desk, lead capture, messaging, workflow automation, and related business services for service businesses and independent professionals.

2. No Guarantee of Results

We do not guarantee any particular business result, revenue outcome, booking volume, conversion rate, or operational improvement. Any examples or illustrations are for informational purposes only.

3. Acceptable Use

You agree not to:

• Misuse the website or services
• Interfere with security or performance
• Use the services for fraud, spam, harassment, unlawful communications, or deceptive practices
• Submit false, misleading, or harmful information
• Copy or exploit our materials in violation of applicable law

4. Client-Managed Communications

If you use our services to handle customer inquiries, calls, messages, or lead capture, you remain responsible for your own business communications, pricing, scheduling, customer treatment, and legal compliance.

5. SMS Messaging Program

Program name: Fairway Ops Lesson Booking Confirmations.

Program description: A low-volume transactional SMS program operated by Fairway Ops LLC on behalf of golf instruction businesses ("coaches") who use the Fairway Ops AI front desk. After a prospective student calls a coach's published business number and verbally agrees to receive a text message, the program sends a confirmation SMS containing the lesson inquiry summary and a booking link. An optional follow-up SMS may be sent to confirm a scheduled appointment time.

Message frequency: Approximately 1–3 messages per lesson inquiry. Frequency does not exceed roughly five messages per recipient per month under normal use.

Message and data rates: Message and data rates may apply. Standard carrier rates apply to messages sent and received under the recipient's wireless plan. Fairway Ops does not charge recipients for SMS.

Opt-out: Recipients can reply STOP at any time to unsubscribe from all future messages. Additional supported opt-out keywords: STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, OPTOUT, REVOKE.

Help: Recipients can reply HELP at any time for support information, or contact team@getfairwayops.com for human support.

Consent: Receiving SMS is never a condition of any purchase or service. Full details about how consent is collected, sample messages, and recording retention are published at getfairwayops.com/sms-consent.

Carrier liability: Carriers are not liable for delayed or undelivered messages.

6. Third-Party Services

Our services may depend on third-party providers. We are not responsible for failures, outages, delays, pricing changes, or policy changes by those providers.

7. Intellectual Property

All website content, branding, workflows, templates, prompts, systems, and materials provided by Fairway Ops are owned by or licensed to Fairway Ops unless otherwise stated. You may not copy, reproduce, distribute, or commercially exploit our materials except as permitted in writing.

8. Disclaimer

The services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Fairway Ops will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost business, lost data, missed opportunities, or reputational harm.

Our total liability for any claim relating to the services or website will not exceed the amount paid to us, if any, during the three (3) months before the claim arose.

10. Privacy

Use of the website and services is also subject to our Privacy Policy.

11. Changes

We may update these Terms at any time. Continued use after changes become effective constitutes acceptance of the revised Terms.

12. Governing Law

These Terms will be governed by the laws of the State of Nevada, without regard to conflict of law principles.
